For individuals with diabilities who have a "waiver", either Supports Waiver or the Now Waiver, the non- profit agency does not act as the employer unless it is a contract with the state through a type of employment development group. Usually in that instance it is a mobile crew contracted to perform duites at a state site. There is individual job support and retention where the non-profit provides job coaches to go with the disabled individual to the job site. The disabled individual is the employee of that company, not the non-profit and the company can certainly claim the WOTC. It is a very simple form, approximately 1 page, and the benefits in hiring an individual with a disability are tremendous.
